Casino operator Genting Malaysia Bhd is suing Walt Disney Co, Fox Entertainment Group LLC and some of its affiliates in U.S. courts for more than $1 billion, multiple media reports said.
Malaysia insists it has bad faith in the suspended theme park project because it opened at the gaming company’s resort world gifting property near the country’s capital, Kuala Lumpur.
The court filed the lawsuit in U.S. District Court in Los Angeles, California, on Monday.
According to media reports, Genting Malaysia said “the seller’s remorse” prompted the game company to violate a 2013 contract with Fox Entertainment Group to license intellectual property rights to the theme park with Disney’s help due to carry themes and rides based on the Hollywood film title library. The theme park was previously referred to as “20th Century Fox World Malaysia” in Genting Group announcements.
“Unlike Fox, which was perfectly happy to be located just off Resort World Genting’s casino as long as Park could continue to earn financial concessions, Disney Group did not want to engage with gambling companies because of its “family-friendly” branding strategy,” Genting Malaysia said in a complaint.
“Given that Fox Entertainment Group does not have the right to terminate the contract, Fox and Disney are liable for damages in excess of $1 billion (W1 trillion) due to Fox and Disney’s misdeeds,” it said in a press release.
Genting Malaysia says it has already invested more than $750 million in the theme park. Malaysia is seeking additional punitive damages.
Walt Disney is currently working to complete a $71.3 billion deal (scheduled to be completed in the first quarter of 2019) to buy Fox Group assets.
Citing the lawsuit, American show business newspaper Variety reported that designers in Genting Malaysia had to recreate “glacial age” animated characters from the start because Fox failed to provide digital assets for the theme park, and took time to obtain permission to use other copyrighted materials.
The lawsuit also states that Fox recently issued a default notice to Genting Malaysia, and that the developer must open the park within 30 days. Genting Malaysia claims that Fox caused delays by withholding approval for various elements of the park or withdrawing approval that had already been approved.
Variety also reported that the defendant claimed to “protect Disney’s existing parks from increased competition” over the genting Malaysia lawsuit.
